In the Estate Planning practice in the United States the Trust Protector is a relatively new concept. Originally started in England, it made it’s way to the United States only recently. As a result, not all Estate Planning attorneys include Trust Protector provisions in living will. Some do, but not all. When you look for the right attorney be sure to ask if they have Trust Protector language in the living trusts they draft.
